TERMS OF SERVICE

Acceptance of Terms

By accessing, browsing, purchasing, subscribing to, or using any services provided by DJ Technologies, including but not limited to web hosting, VPS hosting, dedicated servers, SaaS applications, software development, cloud infrastructure, IT consulting, digital solutions, APIs, and related services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions.

DJ Technologies reserves the absolute right to modify, suspend, discontinue, restrict, or terminate any service, account, feature, pricing structure, or agreement at any time without prior notice where deemed necessary for operational, legal, security, financial, or business reasons.

Continued use of services after modifications constitutes full acceptance of updated terms.

Payments, Billing & Refund Policy

All invoices generated by DJ Technologies must be paid in full before service activation unless explicitly stated otherwise in writing.

All payments made toward hosting services, SaaS subscriptions, development services, infrastructure deployments, licenses, consultations, or managed IT services are strictly non-refundable once provisioning, deployment, development, activation, configuration, or resource allocation has begun.

Trial periods, promotional access, demo environments, discounted offers, and onboarding periods are provided to allow customers to evaluate services before committing to paid plans.

Failure to make timely payments may result in:

  • Immediate suspension or termination of services
  • Permanent deletion of data
  • Cancellation of backups
  • Loss of IP allocations or licenses
  • Additional recovery or reinstatement charges

DJ Technologies shall not be liable for any loss arising from suspended, terminated, expired, or unpaid services.

Chargebacks, payment disputes, fraudulent transactions, or unauthorized payment reversals may result in immediate permanent account termination and legal recovery action.

Service Usage & Acceptable Use Policy

Customers may not use DJ Technologies infrastructure, software, networks, applications, servers, or services for any illegal, abusive, harmful, malicious, fraudulent, or unauthorized activity.

Prohibited activities include but are not limited to:

  • Spam or bulk unsolicited communications
  • Phishing or fraud-related activity
  • Malware hosting or distribution
  • Cryptocurrency abuse or unauthorized mining
  • DDoS attacks or network abuse
  • Hosting illegal content
  • Copyright infringement
  • Unauthorized penetration testing
  • Resource abuse impacting infrastructure stability
  • Adult, extremist, or unlawful material where prohibited

DJ Technologies reserves sole discretion to investigate, suspend, restrict, throttle, or terminate any service suspected of violating acceptable usage policies without refund or prior warning.

Customers remain fully responsible for:

  • All activity under their account
  • Security of passwords and credentials
  • Data stored or transmitted through services
  • Compliance with local and international laws

Infrastructure Availability & Limitation of Liability

While DJ Technologies strives to maintain high availability and stable infrastructure operations, all services are provided on an “as-is” and “as-available” basis without warranties of uninterrupted uptime, continuous availability, or error-free performance.

DJ Technologies shall not be held liable for:

  • Downtime or outages
  • Hardware failures
  • Data loss
  • Cyberattacks
  • Third-party provider failures
  • Software bugs
  • Configuration errors
  • Network interruptions
  • Delayed deployments
  • Force majeure events
  • Financial or business losses

Customers are solely responsible for maintaining independent backups of all data, applications, configurations, and business assets.

Under no circumstances shall DJ Technologies’ total liability exceed the amount paid by the customer for the affected service during the previous billing cycle.

Software Development & SaaS Services

All software development, SaaS implementation, web application development, API integration, automation systems, and digital solution projects undertaken by DJ Technologies are subject to agreed scopes, timelines, technical limitations, and operational feasibility.

Project estimates and timelines are approximate and may vary based on:

  • Client revisions
  • Third-party dependencies
  • Technical constraints
  • Infrastructure requirements
  • Delayed approvals
  • Scope expansion

Unless otherwise agreed in writing:

  • DJ Technologies retains ownership of proprietary frameworks, modules, deployment methods, reusable codebases, and infrastructure tooling.
  • Clients receive usage rights only upon full payment clearance.
  • Source code access may be restricted for SaaS or managed platforms.
  • Ongoing maintenance, updates, support, and security hardening may require separate active agreements.

DJ Technologies reserves the right to refuse, pause, or discontinue projects involving unlawful, unethical, abusive, or technically risky requirements.

Data Protection, Privacy & Security

DJ Technologies implements commercially reasonable security practices to protect hosted systems and customer environments; however, absolute security cannot be guaranteed across internet-connected infrastructure.

Customers acknowledge and accept risks associated with:

  • Cybersecurity threats
  • Unauthorized access
  • Internet vulnerabilities
  • Software exploits
  • Third-party integrations
  • Infrastructure attacks

Customers are responsible for:

  • Maintaining secure credentials
  • Updating applications
  • Securing websites and APIs
  • Managing user access permissions
  • Maintaining external backups

DJ Technologies may monitor systems, logs, traffic patterns, and infrastructure activity for operational, legal, security, abuse prevention, or compliance purposes.

Information may be disclosed where legally required by regulatory authorities, law enforcement agencies, or judicial orders.

Termination, Suspension & Legal Jurisdiction

DJ Technologies reserves the unconditional right to suspend, restrict, terminate, refuse, or modify any customer account, infrastructure allocation, service access, or agreement at its sole discretion where necessary for operational, legal, financial, compliance, abuse prevention, or security reasons.

Termination may occur without notice in cases involving:

  • Payment defaults
  • Abuse complaints
  • Fraud indicators
  • Security threats
  • Legal violations
  • Infrastructure misuse
  • False information submission

Customers remain liable for outstanding dues, damages, recovery costs, legal expenses, and operational losses caused by misuse of services.

Any disputes arising from the use of DJ Technologies services shall be governed under the applicable laws and jurisdiction determined solely by DJ Technologies.
